conditions.

The rules that apply when you buy from this site. They are written to be read, not to be impenetrable.

Who you are dealing with

This site is operated as Charcoal Spit Roasters, trading in Australia at charcoalspitroasters.com.

By placing an order you agree to these terms. If you do not agree with them, do not order.

Orders

Placing an order is an offer to buy. A contract is formed when we accept it, which happens when we dispatch the goods, not when you receive an automated order confirmation.

We may decline or cancel an order before dispatch if:

  • the item is out of stock;
  • a price or product description was listed in error;
  • we cannot deliver to your address; or
  • we suspect the order is fraudulent.

If we cancel an order you have already paid for, we refund you in full.

Prices and payment

All prices are in Australian dollars and include delivery anywhere in Australia.

We are not currently registered for GST. No GST is charged on your order and our invoices do not show a GST component.

Payment is taken through our payment provider at checkout. We do not see or store your full card details. Prices can change at any time, but a change never affects an order we have already accepted.

Delivery and risk

Delivery terms are set out on our shipping page and form part of these terms.

Risk in the goods passes to you on delivery. Title passes once we have received payment in full. Delivery estimates are estimates, not guarantees, and we are not liable for delays caused by the carrier or by events outside our control.

Your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies those rights. Where we are permitted to limit our liability, we limit it to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.

Our returns policy sets out how this works in practice, along with the change-of-mind terms we offer on top of your legal rights.

Using the equipment safely

These are charcoal-burning appliances. They get hot enough to cause serious injury and they produce carbon monoxide, which you cannot see or smell. Read the manual before first use.

  • Outdoors only. Never use a charcoal appliance indoors, in a garage, a tent, or any enclosed or partly enclosed space. Carbon monoxide from burning charcoal kills people every year.
  • Keep it well clear of buildings, fences, overhanging branches and anything else that will burn.
  • Never leave a lit unit unattended, and keep children and animals away from it.
  • Let the charcoal cool completely before moving the unit or emptying the tray.
  • Assemble it as the manual describes and do not modify the frame.

You are responsible for using the equipment safely and in line with the manufacturer’s instructions and any local fire restrictions. We are not liable for injury, fire or damage caused by misuse, modification, or use contrary to those instructions.

This website

The text, photographs and layout on this site are either ours or used with permission, and are protected by copyright. Product images and specifications are supplied by the manufacturer. You may not copy or reuse them commercially without our permission.

We try to keep product information accurate, but we do not warrant that everything on the site is free of error. Where a listing contains an obvious error, we will tell you before we accept the order rather than quietly fulfil something wrong.

Privacy

How we handle your personal information is set out in our privacy policy, which forms part of these terms.

Changes and governing law

We may update these terms. The version published on this page at the time you place your order is the version that applies to it.

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.

If any part of these terms is found to be unenforceable, the rest continues to apply.
